I have been a lawyer for almost 40 years. Trials are fun. Appeals are hard. But, I love appeals. Appeals fix mistakes. Whether the law requires new interpretation, the judge just got it wrong, or the evidence doesn't add up, the court of appeal may fix the problem. Or, it may not due to a lot of hazards built into the system to avoid changing judgments.
I intend this blog to teach how to make appeals work. I write essays about actions to take in the trial to make an appeal better. I write about the appellate process. Hopefully, I write clearly enough that both lawyers, and people without lawyers can navigate through the arcane rules and avoid the hidden rocks and shoals which dash many appeals.
